Before a cosmetic claim reaches the market, teams need to assess more than whether evidence exists. They need to determine whether the claim is legally possible for a cosmetic product, whether the wording accurately reflects the evidence, how consumers may interpret the message, and whether the claim can be defended if challenged.

This session will open with a practical presentation from Kelly Goris, Regulatory Toxicologist & Safety Assessor at The Regulatory Company, bringing the Responsible Person and regulatory review perspective on how claims should be assessed before testing is commissioned or communication is approved.

The presentation will be followed by a panel Q&A with Bird & Bird, bringing the legal perspective on claim wording, consumer interpretation, legal risk, documentation readiness, and defensibility.

Together, the session will examine when a claim should move forward, be narrowed, rewritten, delayed, or rejected — and how regulatory, legal, scientific, claims, and marketing teams can work together earlier to build claims that are not only substantiated, but defensible.
